I am standing here in the Kingdom of God and have not come here to make a plea to any fraudulent statutory charges, or make any contract with anyone.


I have come here to denounce fraudulent, criminal legislation; deceitful legalese and adhesion-contracts; and all those who enact, administer and enforce them, as traitors to God and to us, His servants.


Your honour, have you taken the Oath of Office? Do you have your Oath of Office here in this court? Does it not state that you will uphold to the utmost of your power The Law and ask God to direct and sustain you?


BUNREACHT NA hÉIREANN – CONSTITUTION OF IRELAND.


ARTICLE 34.5.1


Every person appointed a judge under this Constitution shall make and subscribe the following declaration:


"In the presence of Almighty God I, do solemnly and sincerely promise and declare that I will duly and faithfully and to the best of my knowledge and power execute the office of Chief Justice (or as the case may be) without fear or favour, affection or ill-will towards any man, and that I will uphold the Constitution and the laws.

May God direct and sustain me."


Article 34.5.4


Any judge who declines or neglects to make (and obviously to keep) such declaration as aforesaid shall be deemed to have vacated (relinquished) his office.


I hold here in my hand God’s Word, the Holy Bible, that contains "The Laws" that Almighty God commanded us to live by and which our forefathers swore an oath and made a Covenant with God, at Sinai, to keep forever, binding upon their children in perpetuity – that means all of us who are here today and our children in perpetuity.


Deuteronomy 4:3 Your eyes have seen what the "I AM" did because of Baalpeor: for all the men that followed Baalpeor, the "I AM" thy God hath destroyed them [idolaters] from among you.
4:4 But ye that did cleave unto the "I AM" your God [are] alive every one of you this day.
4:5 Behold, I have taught you Statutes and Judgments, even as the "I AM" my God commanded me, that ye should do so in the land where ye go to possess it.
4:6 KEEP therefore and DO [them]; for this [is] your Wisdom and your Understanding in the sight of the nations, which shall hear all these Statutes, and say, Surely this great nation [is] a wise and understanding people.
4:7 For what nation [is there so] great, who [hath] God [so] near to them, as the "I AM" our God [is] in all [things that] we call upon Him [for]?
4:8 And what nation [is there so] great, that hath Statutes and Judgments [so] Righteous as all this Law, which I set before you this day?
4:9 Only take heed to thyself, and keep thy soul diligently, lest thou forget the things which thine eyes have seen, and lest they depart from thy heart all the days of thy life: but teach them thy sons, and thy sons' sons;
4:10 [Specially] the day that thou stoodest before the "I AM" thy God in Horeb, when the "I AM" said unto me, Gather Me the people together, and I will make them hear My Words, that they may learn to respect Me all the days that they shall live upon the earth, and [that] they may teach their children.


29:14 Neither with you only do I make this Covenant and this Oath;
29:15 But with [him] that standeth here with us this day before the "I AM" our God, and also with [him] that [is] not here with us this day [thy children, in PERPETUITY]:


29:29 The secret [things belong] unto the "I AM" our God: but those [things which are] revealed [belong] unto us and to our children for ever, that [we] may do all the words of this Law.


And the people said unto Moses:-


5:27 Go thou near, and hear all that the "I AM" our God shall say: and speak thou unto us ALL that the "I AM" our God shall speak unto thee; and we will hear [it], and DO [it].


God’s Laws are the ONLY Laws of this Prison-Planet, and He has forbidden men from legislating, on pain of death.


Deuteronomy 4:1 Now therefore hearken, O Israel, unto the Statutes and unto the Judgments, which I teach you, for to DO [them], that ye may LIVE, and go in and possess the land which the "I AM" God of your fathers giveth you.
4:2 Ye shall not ADD unto the word which I command you, neither shall ye diminish [ought] from it, that ye may keep the Commandments of the "I AM" your God which I COMMAND you.


Deuteronomy 12:32 What thing soever I command you, observe to do it: thou shalt not add thereto, nor diminish from it.


Deuteronomy 17:9 And thou shalt come unto the priests the Levites, and unto the judge that shall be in those days, and enquire; and they shall show thee The Sentence of Judgment:
17:10 And thou shalt do according to The Sentence, which they of that place which the "I AM" shall choose shall show thee; and thou shalt observe to do according to all that they inform thee:
17:11 According to The Sentence of The Law which they shall teach thee, and according to the Judgment which they shall tell thee, thou shalt do: thou shalt not decline to do The Sentence which they shall show thee, and turn not away from it [to] the right hand, nor [to] the left.
17:12 And the man that will do presumptuously, and will not hearken unto the priest that standeth to minister there before the "I AM" thy God, or unto the judge, even that man shall die: and thou shalt put away the evil from Israel.
17:13 And all the people shall hear, and fear, and do no more presumptuously (in thinking they are a law unto themselves).


Democracy is un-Lawful and treason against God, as is the act of legislating.


Deuteronomy 5:32 Ye shall observe to do therefore as the "I AM" your God hath commanded you: ye shall not turn aside to the right hand (Fianna Fail/PD) or to the left (Fine Gael/Labour).


Deuteronomy 12:8 Ye shall not do after all [the things] that we do here this day, every man whatsoever [is] right in his own eyes.


Those who claim their authority to legislate comes from the people, are gravely mistaken, because the people cannot delegate to anyone a right that they do not themselves possess.


I challenge you to show me anywhere in The Law that you swore to God to uphold, in your Declaration/Oath of Office, where it says that the people have the right to legislate.


I will show you where it says they do not.


Deuteronomy 4:2 Ye shall not ADD unto the word which I command you, neither shall ye diminish [ought] from it, that ye may keep the Commandments of the "I AM" your God which I COMMAND you.


Deuteronomy 12:8 Ye shall not do after all [the things] that we do here this day, every man whatsoever [is] right in his own eyes.

5:32 Ye shall observe to do therefore as the "I AM" your God hath commanded you: ye shall not turn aside to the right hand or to the left.


Therefore the legislation that is being fraudulently used against me is, to use the legal-profession’s own evil and deceitful legalese terminology, Ultra Vires, and thus Null and Void, and thus there is no case to answer.


If you disagree then you will have broken your Declaration/Oath of Office and thus will no longer be in a position to administer justice, with immediate effect, and should immediately step down from the bench and vacate/relinquish your office, as stated in Article 34.5.4 of the Irish Constitution.


Article 34.5.4

Any judge who declines or neglects to make (and obviously to keep) such declaration as aforesaid shall be deemed to have vacated (relinquished) his office.


I also sincerely advise you to remember what Simon Peter said:


1 Peter 4:16 Yet if [any man suffer] as a Christian, let him not be ashamed; but let him glorify God on this behalf.
4:17 For the time [is come] that Judgment must begin at the House of God: and if [it] first [begin] at us, what shall the end [be] of them that obey not the gospel of God?


Acts 5:29 Then Peter and the [other] Apostles answered and said, We ought to obey God rather than men.


If you disobey God, He has told you that you will spend eternity regretting it in the Lake of Fire and Brimstone, with no reprieve.


Amen – so be it.

4:6 And he shall turn the heart of the fathers to the children, and the heart of the children to their fathers, lest I come and smite the earth with a curse (for details see verse 1).


In case they say Jesus annulled The Law, quote this:


Matthew 5:17 Think not that I am come to destroy The Law, or the Prophets: I am not come to destroy, but to fulfill.
5:18 For verily I say unto you, Till heaven and earth pass, one jot or one tittle shall in no way pass from The Law, till all be fulfilled.
5:19 Whosoever therefore shall break one of these least COMMANDments, and shall teach men so, he shall be called the least in the Kingdom of heaven: but whosoever shall do and teach [them], the same shall be called great in the Kingdom of heaven.
5:20 For I say unto you, That except your righteousness shall EXCEED [the righteousness] of the lawyers and politicians, ye shall in no case enter into the Kingdom of heaven.


Which proves them wrong.

Passer By, Im very interested in this piece. Has this Defence worked for anyone?
I feel we are losing spirituality all the time due to people being debt slaves, suffering under crippling mortgages, unlawful licence fees and fixed penalty notices. When I mention this type of defence to people they just laugh.

Good Sabbath evening to everyone,

I hope that everyone is well, in good spirit, and will have a restful and refreshing Sabbath.

I have been researching various ways in which to successfully use the freeman defense within each of the several Union states within the United States of America, and think that I may have possibly found a way to DEMAND that any court located within any Union state be required to take mandatory judicial notice of the freeman defense when it is used.

Every state in the union gives thanks to GOD, or asks for FATHER's help in the preambles to their various Union state Constitutions.

"The constitution of a state is the fundamental law of the State."
[Confer at: Ware v. Hylton, 3 Dall. 199.]

"A constitution is designated as a supreme enactment, a
fundamental act of legislation by the people of the state. A
constitution is legislation direct from the people acting in their
sovereign capacity, while a statute is legislation from their
representatives, subject to limitations prescribed by the superior
authority." [Confer at: Ellingham v. Dye, 231 U. S. 250.]

"The basic purpose of a written constitution has a two-fold
aspect, first securing [not granting] to the people of certain
unchangeable rights and remedies, and second, the curtailment of
unrestricted governmental activity within certain defined spheres."
[Confer at: Du Pont v. Du Pont, 85 A 724.]


Given the above, for any court so situated within any one of these several Union states to deny the admission of the freeman defense, is to be the equivalent of rendering their state's own constitution irrelevant and meaningless, and therefore, their own man made/legislated laws formed under such a constitution would also be just as irrelevant and meaningless as well.

I especially favor the North Carolina preamble where it correctly/properly states that Almighty GOD is the SOVEREIGN RULER of NATIONS (that would be all of them – EVERYWHERE!  This approach may be one possible key to obtaining mandatory judicial notice and action from the courts when using the freeman defense.

I am currently searching for a treaty (possibly between Great Britain and the United States of America) that the United States of America is currently a party to that acknowledges GOD as the SOVEREIGN RULER of NATIONS and/or that the BIBLE is the supreme law of the land.

Via Article 6, clause 2 (the supremacy clause) located within the America's national constitution, the provisions of such a ratified treaty would be elevated to the status of being the supreme law of the land, thereby making all other man made laws inferior/irrelevant laws where any conflict would exist between GOD's laws and these illegal man-made laws. (and we all know that GOD's law clearly invalidates ALL of man's laws. :-)

The supremacy clause would also have a superior effect over inferior Union state/local man-made/legislated laws. Should the various state courts decide to go ahead and invalidate their very own state constitutions and make their underlying laws irrelevant law by refusing to take mandatory judicial notice of their own constitutional preambles, this clause would override their invalidated local laws and would force them to abide by the provisions of a ratified international treaty currently in effect.

Please find each of the several Union states constitution / preambles that clearly shows each state's acknowledgment to/of FATHER, and their dependence and reliance upon him.

Alabama 1901, Preamble. We the people of the State of Alabama, invoking the favor and guidance of Almighty God, do ordain and establish the following Constitution.

Alaska 1956 , Preamble. We, the people of Alaska, grateful to God and to those who founded our nation and pioneered this great land.

Arizona 1911 , Preamble. We, the people of the State of Arizona, grateful to Almighty God for our liberties, do ordain this Constitution...

In continuing with a practical example from my previous post below, please find a rough initial draft of points and authorities that would be applicable to the North Carolina constitutional preamble as it is written in my prior post.

IV. APPLICABLE NORTH CAROLINA LAW

Laws of North Carolina state are required to adjudicate the instant case, for the following reasons.

"The constitution of a state is the fundamental law of the
State." (Confer at: Ware v. Hylton, 3 Dall. 199.)

(1) The Constitution of North Carolina preamble, as it’s initial opening proclamation rightfully acknowledges Almighty GOD (Who is Our FATHER in Heaven) as the Sovereign Ruler of ALL NATIONS, and expresses gratitude and dependence upon him, for the continuance of this state and this nation.

"A constitution is designated as a supreme enactment, a
fundamental act of legislation by the people of the state. A
constitution is legislation direct from the people acting in their sovereign capacity, while a statute is legislation from their representatives, subject to limitations prescribed by the superior authority." (Confer at: Ellingham v. Dye, 231 U. S. 250.)

"The constitution of a state is stable and permanent, not to
be worked upon the temper of the times, not to rise and fall with the tide of events. Notwithstanding the competition of opposing interests, and the violence of contending parties, it remains firm and immoveable, as a mountain amidst the strife and storms, or a rock in the ocean amidst the raging of the waves."

Preamble:

We, the people of the State of North Carolina, grateful to Almighty GOD, the Sovereign Ruler of Nations, for the preservation of the American Union and the existence of our civil, political and religious liberties, and acknowledging our dependence upon Him for the continuance of those blessings to us and our posterity, do, for the more certain security thereof and for the better government of this State, ordain and establish this Constitution.

“We are a religious people whose institutions presuppose a Supreme Being.” (Confer at: Zorach v. Clauson, 343 U.S. 306, 313 (1952).

(2) Article I, Sections 1, 3, 13, and 19 of the Declaration of Rights in the North Carolina state Constitution, have the following headings and topics:

Section 1. Equality and rights of persons.
All persons are created equal, inalienable rights include life, liberty, enjoyment of fruits of own labor, pursuit of happiness.

Section 3. Internal Government of State
People of this State have the inherent, sole, and exclusive right of regulating the internal government, every such right shall be exercised in pursuance of law and consistently with the Constitution of the United States.

Section 13. Religious liberty
All persons have a natural and inalienable right to worship Almighty God according to the dictates of their own consciences, and no human authority shall, in any case whatever, control or interfere with the rights of conscience.

Section 19. Law of the land; equal protection of the laws.
No person shall ... in any manner be deprived of his life, liberty, or property, but by the law of the land. No person shall be denied the equal protection of the laws...
 
(3) Consistent with Sections 1, 3, 13, and 19 above, as listed in the Declaration of Rights in the North Carolina state Constitution, Defendant believes, without further research or specific citations, that North Carolina state statutes support certain aspects of the people’s guaranteed fundamental rights as identified above. Plaintiff further believes that North Carolina law prohibits any diminishment or extinguishment of these protected fundamental rights and interests with appropriate civil penalties and fines being assessed / assigned to any person(s) identified to this court, who have acted in any way to diminish or extinguish these rights in any manner.

V. APPLICABLE BIBLE LAW

Laws of the Bible are required to adjudicate the instant case, for the following several reasons.

(1) As evidenced above under APPLICABLE NORTH CAROLINA LAW in section IV, Almighty GOD (who is Our FATHER in Heaven) is rightfully acknowledged as the Sovereign Ruler of ALL NATIONS in the North Carolina state Constitution preamble.

"This is a Christian Nation" (Confer at: 168 U.S. 625)

(2) The North Carolina state constitution, articles, lawful amendments, and statutes are the controlling internal private law for North Carolina state.

"The basic purpose of a written constitution has a two-fold
aspect, first securing [not granting] to the people of certain
unchangeable rights and remedies, and second, the curtailment of
unrestricted governmental activity within certain defined spheres." (Confer at: Du Pont v. Du Pont, 85 A 724. )


(3) The United States of America, consisting of 50 of the several states of the Union is classified as a Nation. The North Carolina Declaration of Rights in the North Carolina state Constitution under Article I, Declaration of Rights, Section 4, identifies the several states of the Union as an “American Nation”, and “this Nation”.

While making certain not to endorse any denomination of religion over another, the founders of this nation made it emphatically clear that the principles upon which this Nation was built are based squarely upon the Bible.

“The Bible is Law to be applied nationally" (Confer at: 380 U.S. 163)

(4) As North Carolina has rightfully acknowledged that Almighty GOD is the Sovereign Ruler of Nations, GOD’s law is the supreme applicable controlling law within ANY Nation, and any member states.

“We are a religious people whose institutions presuppose a Supreme Being.” (Confer at: Zorach v. Clauson, 343 U.S. 306, 313 (1952).

It is easily seen that Divine Law holds a place in supremacy, even over the "supreme Law of the Land", and constitutional Common/Equity-Law.

In researching further into our practical example of the North Carolina constitution, we find the following information regarding oaths of office:

NORTH CAROLINA STATE CONSTITUTION

ARTICLE VI
SUFFRAGE AND ELIGIBILITY TO OFFICE

Sec. 7. Oath.

Before entering upon the duties of an office, a person elected or appointed to the office shall take and subscribe the following oath:

"I, _______________, do solemnly swear (or affirm) that I will support and maintain the Constitution and laws of the United States, and the Constitution and laws of North Carolina not inconsistent therewith, and that I will faithfully discharge the duties of my office as _______________, so help me God."

Sec. 8. Disqualifications for office.

In our N.C. example state, there is a supporting hierarchy of layers starting with judicial branch oaths and moving up through local, state, national, international, and ultimately to GOD's Supreme laws, statutes, economic policy, etc. As is stated within the various state and national constitutional supremacy clauses, no inferior laws can act in any manner to diminish or extinguish any superior laws.

A judge is an officer of the court, as well as are it's attorneys. A state judge is a state judicial officer, paid by the State to act impartially and lawfully. A federal judge is a federal judicial officer, paid by the federal government to act impartially and lawfully. State and federal attorneys fall into the same general category and must meet the same requirements.

”A judge is not the court.” (Confer at: People v. Zajic, 88 Ill.App.3d 477, 410 N.E.2d 626 (1980)).

A judge cannot use their personal knowledge of the law or feelings while ruling from the bench, they can only rule on the evidence before them. We can explain this to them by saying, "Your Honor, the court cannot use personal knowledge or feelings in rendering a decision, but, must base it's ruling on the evidence submitted to this court."

If judicial officers and other court actors perform actions that are contrary to the boundaries discussed in these previous examples, they have vacated their public office and are performing such acts without any authority to do so.

Other Union states with similar constitutional provisions will have similar constitutional articles, supporting statutes, and judicial oaths which can be cited and used to accomplish the same narrowing effect regarding limiting/focusing judicial discretion in this regard.

I am currently seeking a ratified international treaty that the United States of America is a party to that declares that Almighty GOD is the Sovereign Ruler of Nations and/or that Bible law is the supreme law of the land.

If any forum member has any knowledge of such a ratified international treaty, I would be most grateful for a name or description of such a treaty to continue this research.

I would also welcome any forum member’s feedback or correction of any of these posts, as they are currently rough drafts at this point and are in need of enhancement and fine tuning prior to their use.

The Freeman court defense, as it is currently written, is for defensive purposes.

The information contained in Freeman court defense is perfect as it was originally written. The research efforts and cookbook examples given in the previous posts were provided to allow the user of this defense to have some “by example” material and knowledge of how to create a memorandum of points and authorities specific to their location to support their use of this defense.

This customized memorandum can then be used to capture and focus the attention of the local court while the important message contained within the Freeman defense is being delivered.

Then subsequently, through the use of these previously filed points and authorities, limit the court’s scope and discretion in deviating from performing the actions requested within the Freeman defense.

This same type of approach could work in other countries as well dependent on how their respective constitutions and declarations are worded.

I hope this reply will be helpful to you and others in determining how to best make use of these example memorandum of points and authorities materials.

I have additional materials to provide to everyone on this forum when I have discovered a source naming a ratified international treaty that acknowledges Almighty GOD as the Sovereign ruler of NATIONS and/or that BIBLE law is the supreme law of NATIONS. :-)

They are both really very-weak in regards to their lack of properly and rightfully declaring Almighty GOD as the Sovereign ruler of NATIONS and/or that BIBLE law is the supreme law of NATIONS, but could be used as secondary supporting treaty provisions if another ratified treaty is discovered that declares either one, or both of the above. ))
